The Kentucky legislature has passed a bill that would require a governor to fill a vacant U.S. Senate seat with a member of the departed senator’s party in a move sure to spark the political rumor mill around Frankfort.

Several states have enacted similar legislation but, to my knowledge, it has never been challenged.

However, Article 2 of the US constitution is crystal clear:

When vacancies happen in the Representation from any State, the Executive Authority thereof shall issue Writs of Election to fill such Vacancies.

Thus, the state law regarding a federal Senate post may be in fact, arguably unconstitutional. Being a noisy issue, in Kentucky's case, by the time the Supreme court heard the case, the position would be filled by the 2024 election.
